The following Terms & Conditions (“T&C’s”) are effective as of January 1st, 2025. By agreeing to these T&C’s, You (“The User”) also agree to the following terms related to “First Page SEO” (“The Company”):

Overview and Definitions
- The following Terms and Conditions (“T&C’s”) is a legally binding contract between “First Page SEO” (“The Company” or “The Site”), and You (“The Client”), as a user of the Company’s services. The most current versions of the Company’s Privacy Policy and Terms of Use are incorporated into this T&C’s for reference, and will always take precedence over any older version of the same document, unless otherwise stated.
- First Page SEO offers businesses and individuals access to tools tailored for search engine optimization (“SEO”), online marketing, and online business management, including, but not limited to, tools for link analysis, toolbars, application program interfaces (“APIs”), search analytics, blogs, content generating tools, website profile services, surveys, and polls (Altogether “The Services”).
- You, as Client of the Company, will accept the following:
- By using or accessing the Company’s Services, or if you click or check “I agree” in any or all of the Company’s contractual agreements, you agree to be legally bound by the T&C’s. If you do not agree to these T&C’s, you are not authorized to use any of the Company’s Services.
- You can access portions of the Site using a free account as a free user (“User”). While access to some sections of the Site and specific features of the Services is free, the Company may charge fees for features offered by the Site at any time. Any User who paid to use any of the Site’s Services will be considered a “Subscriber” for these T&Cs. Any reference to “You” or “Your” may refer to the “User” or the “Subscriber”, as applicable.
- By accepting these T&C’s on behalf of any individual, group of individuals, organization, or organizations, then you become legally responsible and are authorized by the Company to take any decision on their behalf. Thereafter, any mention of “You” or “Your” will also include those other individual(s) or organization(s)
- Under its sole discretion, First Page SEO may revise and update these T&C’s at any time and for any reason, effective immediately after posting the changes on the Site. The T&C’s will always show at the top of the page when the T&C’s was revised and modified. It is your responsibility to check any changes made to the current T&C’s.
- You, as Client of the Company, agree that the most recent version of the T&C’s will and always take precedence over any prior version of these T&C’s, including but without limited to, changes on unexpired terms and conditions, and changes on your active subscriptions. You also agree that You are legally bound to these T&C’s in order to use the Site’s Services.
- You can engage in a secondary agreement with First Page SEO by digital or physical means. If there is a conflict between these T&C’s and the terms of use of such secondary agreement, then the terms of use of such secondary agreement will always take precedence over the Site’s T&C’s unless stated otherwise by that secondary agreement.
Terms of Use: Applying to All Users and Subscribers
- The Services provided by the company are only available to Users and Subscribers who:
- Are not bots (only humans) and have a minimum ages of 13 years old for Users and 18 years old for Subscribers;
- Submit and keep updated their account information;
- Are not impersonating a third party or entity, or present untruthful information about themselves on the Site;
- Possess an existing and valid email address; and
- Have not authorized a third party or entity to use their account information (including, but not limited to, profile and messages) to resell the Services of the Site to unauthorized groups or individuals.
- You can engage into agreement with individuals (“your individuals”) who can use any section of the Site or its Services on your behalf. You agree, however, that your individuals must always adhere to these T&C’s, and they must always protect the Services offered by the Company.
- If the Company provides you user authentication and access tools (i.e., user name, password, access keys, etc.) for secure access to the Site or its Services, You agree to keep such account information protected and confidential, and will not share it with third parties that may breach in any way these T&C’s. You also agree that the Company, in its sole discretion, may block you from any restricted sections of the Site or its Services. You also agree to notify the Company immediately of any unauthorized access to your account and use of the Site or its Services that You know about. This includes, but is not limited to, your individuals.
- You acknowledge that sections of the Site and its Services are public and may be accessible by the Company’s Users, syndication programs that use data feed tools, search engines, tools for metasearching, crawlers, and other similar programs.
- First Page SEO reserves the right to monitor your communications to an extent facilitated by the Site or its Services, and may disclose content, communications and information about you, if the Company deems it necessary to:
- respond to a legal process or requirement;
- ensure your compliance with these T&C’s or the Privacy Policy; or
- protect the property of the Company and its rights.
Your Responsibility for Generated Content
- “Generated Content” refers to any and all type of content created by You, including without limitation, profiles, videos, articles, images, data, information, photos, graphics, message, or any other informative or visual material uploaded, published, or displayed by You on the Site and/or by using its Services.
- You are solely and legally responsible for any and all Generated Content created by You.
- You agree that no proprietary rights are or will be violated by your posting, transmission or sharing of any User-Generated Content via any Sites or Services. This includes, but is not limited to, copyright, trade secret, trademark, privacy rights, or intellectual property.
- You agree to not upload, publish, share, or transmit any type of Generated Content that You have no authorization to do so. You also agree that you will not post any comment that violates human rights in any shape or form, or involves any criminal activity, including without limitation, harassment, defamation, violation of privacy, or threats.
The Company’s Responsibility for Generated Content
- First Page SEO is in no way responsible for any Generated Content created by any of its Clients. You accept that the Company is not obligated to create backups of any of the Generated Content. It is your sole responsibility to do so.
- The Company may or may not share the opinions about Generated Content created using the Site or its Services, and will not be liable by such Generated Content. You, as the client, are solely responsible for publishing, sharing, transmitting, uploading, or displaying that Generated Content.
- The Company may, at its sole discretion, delete, modify, or restrict the display of User-Generated Content at any time for any reason, including but not limited to a change in Subscriber account level, or partial or full cancellation of the Services.
- First Page SEO does not own any Generated Content. You own any ownership of any Generated Content created by You, as long as it does not violate in any way, shape, or form these T&C’s.
- You authorize the Company to copy any Generated Content created using the Site or its Services if such action facilitates the storage of that Generated Content on the Site.
Services Available and Obligations
- As Client of the Company, You are allowed to use some of all of the Services, depending on your status described within clause “1C”, paragraph “b” of these T&C’s. These services include, but are not limited to:
- Paid and organic keyword analysis;
- Website audit;
- Access to ranking tracking tools;
- Backlink and competitor analysis;
- Real-time market analysis;
- SEO and PPC competitor research;
- SEO audits; and
- Content optimization automation.
- First Page SEO may limit the use of the Site or its Services at its discretion, including how often you access the Site or its Services or your ability to post Generated Content. The Company reserves the right to change (including without limitation to modify, update, interrupt, suspend or discontinue, temporarily or permanently) completely or partially the Site or its Services without prior notification. You agree that the Company shall and will not be liable for any modification, suspension, or discontinuance of the Site’s Services.
- You can provide First Page SEO with ideas, recommendations, or comments to improve the Site, its Services, or any technologies, products, or activities made by the Company. You agree, however, that you should not expect confidentiality or privacy in any Feedback, and First Page SEO is not obligated to do so. You grant the Company worldwide, non-exclusive, irrevocable, royalty-free, perpetual, fully paid, sublicensable and transferable license to change or use, in any shape or form, any Feedback or materials existing now or in the future that include or incorporate any of your Feedback, including without limitation, the Site or its Services.
- The Company may, at its sole discretion, add new features to the Services available will be included, for the purposes of these T&C’s, as “Beta Services”. Beta Services are, and will always be, a part of the Site’s Services, and all terms in these T&C’s regarding the Site’s Services will also apply to such Beta Services.
- Users acknowledge that Beta Services are or may be untested, have partial functionality, or may not function as intended. By using a Beta Service, you understand, assume, and bear any risk that Beta Services may harm or interrupt operation of your software or hardware. Beta Services are provided “AS IS” and First Page SEO is not liable with any harm associated with any Beta Service.
Copyright Infringement
- If you consider your Generated Content has been used in a way that goes against these T&C’s, or if your intellectual property rights have been in some way, shape, or form violated, then contact immediately [email].
- In order to process your query, you must provide the following documentation without exception:
- Name of the copyrighted work, or list if more than one (1).
- A way for the Company to identify the content on the Services that goes against its T&C’s.
- A statement made by you to prove you are making the claim in good-faith, and it is not authorized by any means by yourself or the law.
- A statement that you are, with the risk of committing perjury, the sole owner of the copyrighted work, or you represent the owner of such work.
- Enough information for the Company to contact you (phone, email, address, etc.)
- Should First Page SEO believe that the work was indeed copyrighted, then the Company, at its sole discretion, will remove the copyrighting work and penalize the user behind it.
User Indemnification
- First Page SEO is, and will not be held responsible by any harm, damage, loss, or liability caused by third parties due to:
- Any Generated Content created using the Site or any of its Services;
- Your unauthorized use of the Site or its Services;
- Providing a link to a third party using the Services;
- Violating these T&C’s; and/or
- Violating the rights (including, but not limited to, intellectual rights) of third parties.
Refund Policy
- To use the Services, the Client must complete payments through any of the valid payment methods. Such payments then become “Funds”, a currency used by the Company that Clients must have and invest to use the Services.
- By accepting these T&C’s, You agree that the Company does not offer a refund on already paid Funds. However, You can request a refund on unused Funds.
- There will be an exception where, under the Company’s sole discretion, the Services doesn’t meet the standards of the Company. In such cases, a refund on already paid Funds may be requested.
- A refund on already paid Funds or unused Funds can be requested using the Customer Support channels. Such refund will take place within the next 14-bank days.
Termination of Contractual Obligations
- All liability obligations between the Client and the Company will remain even after the termination of every and all contractual obligations between both parties.
- Any restriction mentioned in these T&C’s that, by nature, should remain active after the termination of all contractual obligations with the Company will remain active.
- After termination, you are solely responsible for removing all content, information, and material related to you from the Site and any of its Services.
- First Page SEO is, by any means, not responsible for holding information, data, or content related to you.
